PTE 2020-02, which is now in effect, presents challenges and potential opportunities for registered investment advisers, including when considering or recommending rollovers. This has caused significant confusion about what triggers reliance on PTE 2020-02, and exactly how to comply in the face of real-world limitations. At the same time, the transitional period for Rule 206(4)-1 is ending in November. This prompts registered investment advisers to update their advertising and marketing policies and procedures and act accordingly, which can be daunting in the face of a new and untested regulation. This presentation will offer pragmatic options to tackle these major regulatory shifts, from two attorneys who focus their practice almost entirely on registered investment advisers.
